Terms of Service

These terms govern your use of Siteblast's website design, build, hosting and support services. By engaging us, you agree to them.

1.About us

In these terms, "Siteblast", "we", "us" and "our" refer to the sole trader operating under the business name Siteblast (ABN 55 715 476 960), based in South Australia. "You" and "your" means the individual or business engaging us.

2.Our services

Siteblast designs, builds, hosts and maintains websites for small businesses and tradies. Your subscription includes the build, hosting, SSL certificate, CDN, daily backups, security updates and reasonable ongoing content support, as described on our pricing page at the time you sign up.

Add-on services (such as the AEO add-on, additional pages, custom features or third-party integrations) are quoted separately and only provided once you've approved the scope and price in writing.

3.Acceptance and the agreement

A binding agreement is formed when you confirm an order in writing (including by email or by approving a demo) or pay your first invoice. That agreement is made up of these terms, our pricing, and any written scope or quote we provide for your project.

4.Free demo

We may prepare a free demo of your business as a website before you commit. The demo is provided for evaluation only. Until you sign up and pay, you have no rights to use, copy or deploy any part of the demo, and we may modify or remove it at any time.

5.48-hour build guarantee

Once you have signed off on your demo and provided everything we need (content, images, logins, domain access), we aim to publish your live site within 48 hours. If we miss that window because of something within our control, your first month is free. The guarantee does not apply to delays caused by missing content, third-party providers, domain transfer issues, or changes you request after sign-off.

6.Fees and payment

Subscription fees are billed monthly in advance. There is no setup fee and no fixed-term lock-in. Fees are payable in Australian dollars and are inclusive of GST where applicable.

If a payment fails or is more than 7 days overdue, we may suspend access to your site and support services until the account is brought up to date.

7.Price changes

We may change our subscription pricing from time to time. We'll give you at least 30 days' notice by email before any change applies to your account. If you don't accept the new price, you can cancel before it takes effect.

8.Your responsibilities

You agree to:

  • Provide accurate information and content for your site;
  • Hold all necessary rights to any content, images, logos or trademarks you supply;
  • Keep your account credentials secure;
  • Use your site lawfully and not for any purpose that breaches Australian law.

9.Acceptable use

You must not use your Siteblast site to publish or distribute content that is unlawful, misleading, defamatory, infringes another person's rights, contains malware, or that we reasonably consider harmful or offensive. We may suspend or remove content that breaches this clause.

10.Hosting and uptime

We host your site on reputable third-party infrastructure and aim for high availability, but we don't guarantee uninterrupted service. Outages can occur due to maintenance, third-party providers, or events beyond our control. We'll work to restore service as quickly as practical.

11.Backups

We take regular backups of your site as part of your subscription. Backups are intended for our internal disaster-recovery use and are not a substitute for you keeping your own records of important content.

12.Changes and support

Reasonable content changes (text edits, swapping images, adding a service or testimonial) are included in your subscription. Larger work — new pages, redesigns, custom functionality, integrations — will be quoted separately and only started after you approve.

13.Third-party services

Your site may rely on third-party services (for example, hosting, domain registrars, email providers, analytics, payment processors or AI tools). Their own terms apply to their services, and we are not responsible for their performance or actions.

14.Intellectual property

You retain ownership of the content, logos, images and trademarks you supply. While your subscription is active, you have a non-exclusive, non-transferable licence to use the website we build and host for you for the operation of your business.

We retain ownership of our underlying tools, templates, frameworks, code libraries and know-how. Nothing in these terms transfers ownership of those to you.

15.If you cancel

You can cancel any time by emailing hellositeblast@gmail.com. Cancellation takes effect at the end of your current billing month, and your site will be taken offline at that point. We can provide an export of your written content on request. Custom code, templates and design assets remain our property.

16.If we cancel or suspend

We may suspend or terminate your service if you breach these terms, fail to pay, use the service unlawfully, or behave abusively toward our team. Where reasonable, we'll give you a chance to fix the issue first.

17.Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot be lawfully excluded.

18.Warranties and disclaimers

To the extent permitted by law, our services are provided "as is". We don't warrant that your site will achieve any particular search ranking, traffic level, conversion rate, or business outcome.

19.Limitation of liability

To the maximum extent permitted by law, our total liability to you arising out of or in connection with the services in any 12-month period is limited to the fees you paid us in that period. We are not liable for any indirect, incidental, consequential, special or loss- of-profit damages.

20.Indemnity

You agree to indemnify Siteblast against any claim brought by a third party arising from content you supply, your use of the services in breach of these terms, or your breach of any law.

21.Privacy

We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

22.Changes to these terms

We may update these terms from time to time. We'll publish the current version on this page and, where changes are material, give you reasonable notice by email. Continuing to use the service after changes take effect means you accept the updated terms.

23.Governing law

These terms are governed by the laws of South Australia, Australia. You and Siteblast submit to the exclusive jurisdiction of the courts of South Australia and the federal courts of Australia.
